GENERAL

Harris & Harris, LLP ("H&H") is a law firm. The following is the website of H&H: http://www.harris-harris.com ("Website").

This document sets forth H&H's Notice of Website Privacy Practices ("NWPP") for the Website. H&H wants you to know (1) how it may use information about you collected electronically from your use of H&H's Website and (2) that no attorney-client privilege is created from your use of the Website.

If you have objections to this NWPP, you should not access or use the Website. By using the Website, you consent to H&H's use of information that is collected as set out in this NWPP.

This NWPP does not govern the collection, use, and protection of information by H&H offline, i.e. other than through the Website.

This NWPP explains H&H's privacy practices with regard to its Website. The following shall not, however, be construed as a contractual promise with regard to H&H's privacy practices with regard to its Website, and H&H reserves the right to amend it at any time without notice and at its sole discretion.

LEGAL NOTICES OF TERMS AND CONDITIONS

The Website has been prepared for informational purposes only, does not necessarily reflect the opinions of H&H's clients or attorneys, and does not constitute legal advice. You should not act or refrain from taking action based upon information on the Website. The Website is not intended to be a substitute for legal advice regarding the facts and circumstances of your specific situation.

The Website is not intended to constitute advertising or solicitation. Some jurisdictions, however, may consider the Website to constitute advertising. The hiring of a lawyer is an important decision that should not be based solely upon written information about H&H's qualifications and experience as set forth on the Website. H&H does not intend to represent you based on your review of any portion of the Website if such portion fails to comply with the applicable laws, regulations, and/or rules of the jurisdiction in which you are accessing the Website.

NO REPRESENTATION IS MADE THAT THE QUALITY OF LEGAL SERVICES TO BE PERFORMED IS GREATER THAN THE QUALITY OF LEGAL SERIVCES PERFORMED BY OTHER LAWYERS. Also, H&H's attorneys are not certified by any board of specialization of any state.

The Website and all elements thereof are provided on an "as is" basis without warranty of any kind, express or implied. H&H makes no warranties or representations as to the accuracy of the content contained on the Website or that the information presented on the Website is current or up-to-date. H&H does not warrant that the Website will operate or perform in a manner that is uninterrupted or error-free or that the Website or host server will be maintained free of viruses or other harmful code.

Neither H&H nor any of its employees or agents shall be held liable for any improper or incorrect use of the information described and/or contained in H&H's Website and assumes responsibility for anyone's use of the information.

Under no circumstances, and regardless of legal theory, whether in tort, contract, or otherwise, will H&H or any of its employees, agents, or affiliates be liable to you or any other party for any direct, indirect, special, incidental, punitive, or consequential damages, however caused, and regardless of character, including, without limitation, any damages arising in any way out of the use of the Website including, but not limited to, those caused by the lack of a response from H&H, failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, communication line failure, computer virus, the loss of data from or the failure or malfunctioning of your computer, theft or destruction or unauthorized access to, alteration of, or use of record.

Construction of the disclaimers herein and resolution of all disputes arising out of same are governed exclusively by the laws and by the courts of the State of Alabama. The laws of the State of Alabama shall apply to all uses of this data and the Website.

H&H's Website is intended for use by adults. H&H's Website is neither directed to nor intended to collect any information from children.

INFORMATION H&H COLLECTS and HOW H&H MAY USE IT

"Personally identifiable information" is any information that identifies or can be used to identify, contact, or locate the person to whom such information pertains. Personally identifiable information collected by H&H will be subject to the version of the NWPP in effect at the time it was collected.

H&H collects information two ways when you interact with the Website: Information automatically collected when you use the Website and information you provide on the Website.

Automatically Collected Information

When you access the Website, our web servers automatically log information about visits to the Website. For example, when you visit the Website, server logs automatically record statistical information such as your Internet Protocol (IP) address and other traffic data.

No personally identifiable information about you is revealed in this process.

This information may be used by H&H to administer the Website, to analyze its usage, to protect the Website and its content from inappropriate use, and to improve your experience. Traffic and transaction information may also be shared with third parties on an aggregate and anonymous basis.

Information You Provide

The only personally identifiable information collected by H&H's Website is your email address, which you deliberately choose to provide. Providing your email address and/or any content, whether or not you consider either or both confidential, does not unilaterally create an attorney-client relationship between you and H&H.

H&H will use your email address to respond to your email if, in H&H's discretion, it decides to do so. H&H reserves the right not to read or to respond to any unsolicited email communication via the Website.

If H&H chooses to respond to your email, it does not create an attorney-client relationship between you and H&H.

To be clear, neither an email from you to H&H via the Website nor an email response from H&H will establish an attorney-client relationship between you and H&H. No attorney-client relationship exists between you and H&H unless and until an attorney with H&H expressly agrees in writing that the firm will undertake to represent you.

Therefore, if you are not a client, any unsolicited information you transmit to H&H via the Website can be used by H&H for any purpose whether or not you consider the information confidential or sensitive. H&H does not agree to maintain the secrecy of any unsolicited information you send to H&H.

WHO HAS ACCESS TO PERSONALLY IDENTIFIABLE INFORMATION YOU PROVIDE VIA THE WEBSITE

Even though no attorney-client relationship exists between you and H&H unless and until an attorney with H&H expressly agrees in writing that the firm will undertake to represent you, H&H does not sell, rent, or lease your email address to others.

No data transmission over the Internet can be guaranteed to be 100% secure. Therefore, H&H cannot guarantee the security of any information you transmit to or from the Website, and you do so at your own risk and subject to the disclaimers of liability in this NWPP.
